Terms of Use

1. General Information

Packup! is an app and service offering by Marvin Auler, sole proprietor (hereinafter referred to as the "Provider"), based in Germany. By using Packup!, the user confirms to have read and understood these terms of use and expressly agrees to them.

1. Usage

Packup! is provided to the user free of charge. Certain features of Packup! may be available for subscription or purchase. To use all features, registration with a user account, including a valid email address, and an internet connection may be required.

The Provider's offering is partly made through app stores and their infrastructure, such as the Apple App Store and the Google Play Store. The user uses such app stores independently of the Provider, and the respective terms of use apply.

For certain features of Packup!, access to the address book, photo album, location data, or other data on the user's device may be required. Such access is granted only with the explicit consent of the user and enables, for example, uploading a profile picture or sharing content with contacts. Depending on the device's operating system, the user can confirm or block this access.

Packup! allows the sending of messages between Packup! users and to third parties, such as via email. The user agrees to receive such messages and undertakes not to send or allow the sending of any unlawful content. The Provider reserves the right to contact the user at any time via Packup! or by email.

Packup! may enter into collaborations with third-party providers that enable users to obtain services or goods through the app. In such cases, the contract is concluded directly between the third-party provider (e.g. merchant) and the user. The Provider merely acts as an intermediary and is not a contracting party. The terms and conditions and privacy policies of the respective third-party provider apply to such contracts.

The user grants the Provider a free, non-exclusive, worldwide, and sublicensable license to use copyrighted content that the user provides in connection with the app, to the extent permitted by law.

The Provider strives for high availability and reliability of Packup! ("best effort"). However, it cannot be guaranteed that Packup! or individual features are permanently, at all times, and/or completely available. Users should regularly perform data backups to avoid data loss, including Packup! data.

There is no entitlement to the use of Packup!. The Provider may discontinue the provision of the app at any time without giving reasons, modify the app, or exclude individual users from using it.

2. Liability

The Provider assumes no liability for direct or indirect damages arising from the use of Packup! or in connection with Packup!, unless there is mandatory legal liability.

The user expressly releases the Provider from any liability and undertakes to indemnify the Provider from any damages, claims, or costs arising from a violation of these terms of use or the rights of third parties.

3. Legal

The Provider reserves the right to change these terms of use at any time. Changes will be communicated to the users in an appropriate manner. By continuing to use Packup! after being notified of the changes, the user agrees to the amended terms.
